What is Expungement?

Under the California Penal Code, expungement allows a defendant who has successfully completed their probation to petition the court to withdraw a plea of guilty or no contest and reenter a plea of not guilty and have their case dismissed.

Expungement means you do not have to suffer many of the negative consequences of your conviction, primarily because you are no longer required to disclose the conviction to anyone. Not disclosing a criminal conviction opens many doors that are otherwise closed to you, such as finding housing or getting a job.

Expunged convictions can still be used against you for harsher sentencing for subsequent convictions, such as the application of the “three-strikes law.” It cannot restore a driver’s license that has been suspended or revoked or restore gun rights subject to the state’s felony firearm law. It also does not keep you from appearing on the sex offender registry.

To be eligible for expungement, you must have successfully completed probation and cannot have served a prison sentence unless that conviction would now result in a jail sentence under the realignment of Proposition 47.

Who is NOT Eligible?

Those who were sentenced to prison are not eligible for expungement (unless with the Proposition 47 exception), nor are those convicted of sex crimes involving children. Also not eligible are those currently charged with a crime, on probation, or serving a sentence.

What are the Benefits
of an Expungement?

The benefits of expungement are well worth the time and money it takes to obtain it. It is an investment in your future.

You no longer need to disclose the conviction on employment applications. Although an employer might be able to find a record of the conviction, they can no longer use it to deny employment. Expungement makes it easier to obtain a professional license. It prohibits a conviction from being used to impeach you in court. It can even help keep you from being deported.

What is the Process?

Although you can ask the court in person to expunge your conviction, it is wise to use the services of an attorney who can review the circumstances of your case to make sure you meet the criteria for expungement under current law. Your attorney will then draft and file a petition for expungement and appear in court on your behalf.

If the court decides to accept your petition to withdraw your plea of guilty or no contest, or — if you entered a not-guilty plea but were convicted — agrees to set aside the conviction, the court will release you from all penalties and consequences of the conviction.
